General Policy

By the action of setting up a profile and/or entering their User ID and Password on HireShield.com, User certifies that their requested report(s) are for their personal and/or professional use only, in accordance with FCRA guidelines, and that no misrepresentation has occurred. 

The HireShield.com confidential website access is available only to individuals and any other legal entities that can form legally binding contracts under applicable law. User warrants that anyone provided the confidential Username and Password can view/run a background check on the subject. This includes any agreements that User enters or forms on behalf of a third party including, but not limited to, any entities of whom are an employee of User, manager, owner, or for whom may act as an agent; with either actual or apparent authority to form binding agreements as those terms are defined by State/Federal law. 

User hereby certifies that the use of all information provided by HireShield.com under this Agreement (Consumer Report) shall follow the Fair Credit Reporting Act, Public Law 91-508. User agrees to abide by the provisions of the Fair Credit Reporting Act and understands that the information received from HireShield.com shall be received as a “consumer report” within the meaning of the Act. User further agrees that all information requested will be for exclusive use only for personal/employment purposes or in connection with legitimate business needs, as outlined in section 604 of the Fair Credit Reporting Act. User understands that reports may be requested only by its designated agents and that employees are not to obtain reports except in the exercise of their official duties. Willful acquisition of a Consumer Report under false pretenses is punishable by law. If the employment process is suspended or terminated because of information provided in the Consumer Report, User shall comply with the provisions of the Fair Credit Reporting Act, including but not limited to, those provisions requiring User to disclose information to a prospective employee or applicant. This includes providing the applicant/employee a copy of the report and a copy of A Summary of Your Rights under the Fair Credit Reporting Act. NON-GLB; by using HireShield.com, you agree to abide by all FCRA rules and regulations. 

Further, User acknowledges that the depth of information provided by HireShield.com may vary from source to source. Therefore, User also acknowledges that HireShield.com shall not be a guarantor of information accuracy or completeness. User agrees that the final verification of an individual’s identity and proper use of report contents shall be the User’s sole responsibility. HireShield.com shall be held harmless from any results and shall be indemnified by any Users. HireShield’s role in the background check process on HireShield.com is to connect the third-party vendor to the request. HireShield.com agrees to provide timely dissemination of available information in a manner consistent with standard business practices.

User agrees to pay for all searches conducted on their behalf at their current rate at the time that the search commences. Once the request has been submitted to HireShield.com, it is not cancel-able. As a condition to ordering and obtaining consumer reports from HireShield.com, User agrees as follows:

A. That User will use such report solely for employment purposes and for no other purpose. Employment purposes include the evaluation of the subject of the report for employment, promotion, reassignment, or retention as an employee. The subject of the report (“Applicant”) includes any consumer who is an applicant, Independent Contractor, potential employee or employee.

B. Prior to ordering the report, or causing the report to be ordered:

(1) User has made clear and conspicuous written disclosure to the Applicant, in a document consisting solely of the disclosure, that a report may be obtained for employment purposes; and
(2) User has obtained the Applicant’s written authorization to obtain the report; such authorization may be in the same document as the disclosure.

C. Prior to taking any adverse action based in whole or in part based upon the report, User will provide the following to the Applicant.

(1) A copy of the report; and|
(2) A written description of the rights of the Applicant under the Fair Credit Reporting Act (“FCRA”) as prescribed by the Federal Trade Commission (“FCRA Summary of Rights”). HireShield.com can provide User a copy of the FCRA Summary of Rights, and it can be obtained from HireShield.com or the FTC’s website (http//:www.ftc.gov).

D. Before User takes any adverse action against the Applicant based in whole or in part on the report, User shall give the Applicant a reasonable amount of time after the copy of the report and FCRA Summary of Rights have been received to dispute the accuracy and completeness of the information in the report.

E. If User takes any adverse action with respect to the Applicant based in whole or in part on any information in the report;

 User will provide the Applicant with all of the following:

(1) Notice of the adverse action;
(2) HireShield.com name, address, and telephone number;
(3) A statement that HireShield.com did not make the decision to take the adverse action and is unable to provide the Applicant the specific reasons why the adverse action was taken;
(4) Notice of the Applicant’s right to obtain a free copy of the report from HireShield.com if, within 60 days after receipt of the notice, he or she requests a copy from HireShield.com, and
(5) Notice of the Applicant’s right under the Fair Credit Reporting Act to dispute with HireShield.com the accuracy or completeness of any information in the report. 

In the event that User orders from HireShield.com any investigative consumer report, then in addition to User’s other certifications herein, User certifies to as follows with respect to each investigative consumer report ordered: 

(1) Not later than 3 days after the date of requesting such report from HireShield.com, User will mail or otherwise deliver a written disclosure to the Applicant containing the following information:

(i) A statement that clearly and accurately discloses that an investigative consumer report on the Applicant may be made and such report may contain information as to his or her character, general reputation, personal characteristics and mode of living (as applicable); and
(ii) A statement informing the Applicant of his or her right to request in writing additional disclosures  about the nature and scope of the investigations and a written summary of rights (FCRA Summary of Rights).

(2) Upon written request by the Applicant within a reasonable period of time following the Applicant’s receipt of the disclosure referred to in subsection “C” above, User shall make a complete and accurate written disclosure of the nature and scope of the investigation User has requested. User will mail or otherwise deliver the nature and scope disclosure to the Applicant not later than 5 days after the date on which the request for such disclosure was received from the Applicant or such investigative consumer report was first requested, whichever is later.

(3) If User operates in California or orders a report on a California resident, in addition to the other certifications herein User hereby certifies for each California report ordered from HireShield.com that:

(i) User will identify HireShield.com including the name, address, and telephone number;
(ii) User will have a disclosure with a box that can be checked by the Applicant to indicate that he/she wants to obtain a free copy of the credit report; and
(iii) User will provide the Applicant a summary of his or her rights under California Civil Code Section 1786.22.
(iiii) Prior to an adverse hiring decision, employer will perform an Individualized Applicant Assessment for hiring suitability evaluation.

(4) User is aware that in addition to the FCRA and other federal laws, state laws may be applicable to your ordering and use of consumer and/or investigative consumer reports, and agrees to comply with all applicable federal and state laws.

(5) User agrees that all certifications and agreements herein are of a continuing nature and are intended to apply to each consumer and/or investigative consumer report that User orders from HireShield.com. User agrees to keep all documentation signed by the Applicant required herein for at least 3 years after the date of the report to which such documentation relates and to provide HireShield.com copies upon request.

F. User agrees that it shall use The Products only for its exclusive use, and to hold the information in strict confidence and not to disclose it to any third parties. The Products will be requested only by the User’s designated and authorized representatives. Employees will be forbidden to attempt to obtain any of The Products on themselves, associates, or any other person except in the exercise of their official duties.

G. User will not use any information in the report in violation of any applicable Federal or State equal employment opportunity law or regulation. HireShield.com does not represent or warrant that its services will prevent any loss, that its services may not be circumvented or that its services will provide the protection or information for which the services were intended in good faith.

HireShield.com agrees not to discriminate against any employee or applicant for employment because of race, creed, color, age, sex, disability, or nationality. User agrees to defend, indemnify and hold harmless HireShield.com, and its owners, officers, directors, shareholders, employees, agents, contractors, affiliates and attorneys from all liabilities, claims, losses, causes of action, (including attorney’s fees and costs) or any kind or nature, arising out of or in connection with the performance of the services or information to be provided by HireShield.com under this Agreement, or any Addendum thereto.

The Terms and Conditions and other disclosures on the website are intended by the parties as a final expression of their agreement and as a complete and exclusive statement of the terms thereof and supersedes all prior representations, understandings or arrangements of the parties. No waiver of a breach of any term or condition of this agreement shall be construed to be a waiver of any succeeding breach. The action of User in the use of and placing of orders from the HireShield.com secured website certifies their acceptance of the previous Terms and Conditions of Use for the products and services supplied by HireShield.com to User.

Information We Collect

The types of information we collect about you depends on your use of our products, services and the ways that you interact with us.  This may include information about:

    • How you use or visit websites, accounts with Hireshield or applications.
    • How you use services and products and interact with those services or products.
    • Contact, billing and other information you provide.
    • Improve and develop our products and services.
    • Personalize our products and services and make recommendations.
    • Advertise and market to you, which includes sending promotional communications, targeting advertising, and presenting you with relevant offers.

We also obtain information from third party sources. We protect information obtained from third parties according to the privacy practices as described in this Privacy Statement.  These third party sources vary over time and may include:

    • Data brokers from which we purchase demographic data to supplement the information we have collected about you.
    • Communication services, including email providers and social networks, when you give permission to access your information on such third party services or networks.
    • Partners with which we offer co-branded products or services, or engage in joint marketing activities.
    • Publicly available sources, such as open government databases.

The personal information we collect can include the following:

    • Contact details such as your name, email address, home address, contact telephone numbers.
    • Employment information such as your job title and other business or company information.
    • Credentials such as your passwords, password hints, and similar security information used for authentication and Account Detials access.
    • Demographic information such as your age, gender, country, interests, and preferences;
    • Web form information you provide in our web forms (forms that you choose to complete will indicate whether the information requested is mandatory or voluntary);
    • Payment information to process payments, such as your payment instrument number (such as a credit card number) and the security code associated with your payment instrument.
    • Account history information related to the products or services you purchase, and the activities associated with your account.
    • Cookie and tracking information such as IP address, device identifier, location data, browser type and language, access times, the Uniform Resource Locator (URL), other unique identifiers and other technical data that may uniquely identify your device, system or browser.
    • Browse history information about the websites the websites you visit.
    • Error reports and performance information of the products and any problems you experience, including error reports.
    • Troubleshooting and help information when you contact Hireshield for technical support or customer support services, phone conversations or chat sessions with our representatives may be monitored and recorded.
    • Content consumption information about media content (e.g. T.V., apps and games) you access through our products.
    • Feedback and ratings information you provide to us such as customer survey feedback and product reviews you write.
    • Configuration Data including how you use the Services (including those applications, clouds, and other sites you connect to with the Services);
    • Feature Use including how you interact with Services.

How We Use and Share Your Information

We use and share your information to:

    • Deliver and maintain our products and services and related infrastructure.
    • Establish and maintain your account.
    • Measure credit and payment risk.
    • Provide account related services and information.
    • Help you with customer service and technical support issues or questions.
    • Conduct statistical analysis.
    • Help us improve or personalize our products and services.
    • Better predict content and marketing offers that may interest you, which includes sending promotional communications, targeting advertising, and presenting you with relevant offers.
    • Authenticate you.
    • Detect and prevent fraud.
    • Manage and protect our networks, services and customers.
    • Meet our legal obligations and doing research.
